SAFECO Insurance Companies Settle Georgia Diminished Value Action for $2,346,535

The parties have reached a tentative $2,346,535 settlement in an action filed against SAFECO Insurance Company of America and numerous affiliated companies on behalf all persons insured by an automobile insurance policy issued in Georgia by the defendants and who made a claim for damage to their vehicles under their collision, comprehensive, underinsured, or uninsured motorist coverage for a loss that occurred between June 19, 1997, and November 28, 2001. The action sought reimbursement for the diminished value of these vehicles due to their having been repaired. Though there is no claims deadline at this time, persons who are eligible to take part in the settlement who have not received a notification letter should act as soon as possible to alert the company of their eligibility.

Under the settlement, the companies have agreed to reimburse those drivers the amount by which the value of their vehicles was reduced--its so-called "diminished value"--by the mere fact that it was involved in an accident and then repaired. The theory of diminished value asserts that buyers choosing between two otherwise equal vehicles will select the one that has not been previously damaged and repaired, even where the repairs to the other vehicle were first-rate. Therefore, this theory contends, the very fact that a car has been involved in an accident causes the car to lose value, even if it was fully repaired.

Also named as defendants in the action are American Economy Insurance Company, American States Insurance Company, American States Preferred Insurance Company, First National Insurance Company of America, General Insurance Company of America, SAFECO Insurance Company of Illinois, and SAFECO National Insurance Company. All defendants are SAFECO Companies.

The class is made up of persons who were insured under a Georgia automobile insurance policy issued by SAFECO, or one of its subsidiaries, who reported one or more valid physical damage claims for vehicle damage under that policy’s collision, comprehensive, or uninsured motorist coverages, which occurred and was reported between June 19, 1997, and November 28, 2001.

The settlement will not be effective until the court grants it final approval. The court has scheduled a hearing on the matter for January 16, 2004.

A class action lawsuit has been filed in the Northern District Court of Illinois against Abbott Laboratories and Hospira, Inc. for violations of the employee retirement income security act (ERISA).
 
The parties have reached a settlement apparently valued at $5,850,000 in an action filed against the Insurance of America Agency, Inc., the National Business Association, Inc., the American National Insurance Company, Inc., and the American National Life Insurance Company of Texas on behalf of all persons (1) who obtained certificates of insurance from American National Life Insurance Company of Texas, Inc., or American National Insurance Company, that were the subject of a trust agreement in which those companies were the administrators for the National Business Association insurance program after October 12, 1996, or (2) who were over eighteen as of July 1, 2003, and were insured under certificates containing a co-pay and wellness benefit rider offered by American National Life Insurance Company of Texas when notices issued in their state of residence that the rider was to be deleted. Persons who have not received notification, but are eligible to take part in the action should contact class counsel as soon as possible.

A class action has been filed against the U.S. Department of Health and Human Services and its secretary, Tommy Thompson, on behalf of Medicare beneficiaries in Suffolk, Nassau, Westchester and Rockland counties in New York who allege that disparities in Medicare+Choice coverage between New York City and its suburbs are the result of unconstitutionally unequal treatment. The action asks the court to make the government to pay back seniors in the four suburban counties for premiums they paid into the Medicare Plus Choice program since January 1, 2001.
 
A class action lawsuit has been filed in the Western District Court of Washington against Prudential Insurance for violations of. Class members seek compensatory damages, punitive damages, and damages under the Washington State Consumer Protection Act as well as for costs and attorneys' fees pursuant to the litigation.
 
A class-action lawsuit filed in federal court in Miami, Florida, alleges that cell phone insurance is being promoted in a “deceptive and outrageous” manner by cell phone equipment insurers. The lawsuit alleges replacement telephones are often cheap, used, or refurbished models which further decrease the value of the insurance and monthly premiums are misleading since they don't really insure the phone in the event of a loss.
