Female and Minority Workers and Applicants Certified as Class Against West Virginia Department of Transportation

The parties have reached a tentative $700,000 settlement in an action filed against the West Virginia Department of Transportation, Division of Highways, on behalf of women and racial minorities who are current of former employees of the Division, or who applied or were deterred from applying for jobs between January 1, 1989, and March 31, 2003. The action alleges that the Division discriminated against these groups in violation of state civil rights laws. Eligible persons should contact the class attorneys for more information as soon as possible.

There are two proposed classes under the settlement. The first is made up of all women who, from January 1, 1989, to March 31, 2003:

(1) unsuccessfully applied or bid for employment in permanent, regular, non-traditional positions with the Division;
(2) were deterred from applying for permanent, regular, non-traditional positions with the Division; and
(3) were for any period of time employed in permanent, regular, non-traditional positions by the Division.

The second class is made up of all racial minorities who, from January 1, 1989, to March 31, 2003:

(1) unsuccessfully applied or bid for employment in permanent, regular, non-traditional positions with the Division;
(2) were deterred from applying for permanent, regular, non-traditional positions with the Division; and
(3) were for any period of time employed in permanent, regular, non-traditional positions by the Division.

The settlement will not be effective until the court grants it final approval. The court has apparently not yet scheduled such a hearing.

A class action lawsuit has been filed in the Chancery Division of Cook County (Chicago) Superior Court against Illinois based retailer Sears Roebuck & Co. The case was brought by the Central Laborers Pension Fund and may involve the company’s benefit plans. No additional information about the substance of the allegations is available at this time. State and federal labor law protects workers from being discriminated against based on their age, among other things. A class action has been filed against Domino's Pizza, Inc., on behalf of all people over the age of 40 who were fired by Domino's since David Brandon became CEO in 1999. The action alleges that the pizza chain violated Michigan labor law by firing older workers to replace them with younger workers, and seeks unspecified compensatory and punitive damages.
 
A statewide collective action has been filed in Alabama against Lowes Companies, Inc. The action is brought on behalf of all hourly and salaried employees of Lowes that have worked beyond 40 hours per week without proper overtime compensation. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, each potential claimant is required to "opt-in" in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants.
 
A class action has been filed on behalf of workers at the Huntington, West Virginia call center once operated by Telespectrum Worldwide, Inc. The complaint alleges that the surprise closing of the call center violated the federal Worker Adjustment and Retraining Notification (WARN) Act and caused damage to the plaintiffs. The lawsuit seeks financial and other damages on behalf of the entire class.
 
A class action lawsuit has been filed in U.S. District Court for the Northern District of Ohio against newspaper conglomerate Village Voice Media Inc. The case involves violations of federal labor law. No additional information about the substance of the allegations is available at this time.
