Pennsylvania Residents Cry Foul Over Collection Letters

A statewide class action has been filed in Pennsylvania against Irv Borenstein, Esq. This action is brought on behalf of all Pennsylvania residents who, since December 5, 2002, have received a letter from Borenstein's law firm in an attempt to collect a debt. Consumers allege that certain language contained in the letters sent by Borenstein violate the federal Fair Debt Collection Practices Act and are seeking unspecified compensatory damages, statutory damages and injunctive and declaratory relief.

According to consumers, Borenstein and his law office are engaged in the business of debt collecting. Consumers allege that they were contacted by Borenstein's office through the use of a "form" type collection letter, in an effort to collect a debt for CACV of Colorado, a credit card company. This letter contained language that stated "please call our office immediately" and also informed the consumers that they were required to notify the office in writing if they wished to prevent telephone calls from being made to their
homes and/or workplace. According to consumers, these statements violate the provisions of the federal Fair Debt Collection Practices Act. The consumers allege that by demanding they call Borenstein's office immediately, the language of the letter was misleading and unfair because it contradicted, overshadowed and obscured the required language concerning validating and verifying the correctness of the alleged debt. The consumers state that this language was intended to be, and was in fact, confusing to the consumers and intimidating. Additionally, the consumers allege that the language concerning future telephone calls violated the Act because it was untrue and coercive. The consumers claim that this language led them to believe that in the near future they would be contacted by phone at their home and/or workplace if they did not pay their debt immediately. According to consumers, it is also a false statement. Consumers are not required by law to contact a debt collector in writing to request cessation
of collection phone calls at their place of work. The consumers claim that these actions were wanton, willful and intentional violations of state and federal law whose only purpose was to intimidate consumers into making immediate payment of the alleged debts.

Other Credit / Debt Cases of Interest

The parties have reached a tentative $185,000 settlement in a class action filed against Sears National Bank, doing business as Sears MasterCard, on behalf of all Sears National Bank MasterCard holders who participated in the March 2001 promotion offered by Sears MasterCard for 2.9% interest for four months on all promotional checks clearing Sears National Bank on or before May 1, 2001, and who did not receive the 2.9% interest rate. Claim forms must be postmarked on or before October 30, 2004, in order to be considered valid.
 
The parties have reached a $1.6 million settlement in an action filed against Ameriquest Mortgage Company, on behalf of all persons who obtained Ameriquest, Argent Mortgage Company, Town & Country Credit Corporation; or Olympus Mortgage Company variable rate loans between June 1, 1998, and June 30, 2003, which were secured by real properties in the State of California, and who paid a prepayment charge in excess of that permitted by the California Civil Code. Persons with outstanding loans, who might still be subject to prepayment charges from these companies should also submit claim forms. Claim forms must be postmarked no later than November 19, 2004, to be considered valid.
 
A class action lawsuit has been filed against H&R Block, a national tax preparation company, in the Southern District Court of West Virginia for violations of federal banking laws. Class members seek damages, attorney's fees and costs of the litigation.
 
A class action lawsuit has been filed in US District Court against ACE INA Holdings. The case involves violations of Federal Antitrust law. No additional information about the substance of the allegations is available at this time. A statewide class action has been filed in California against collection specialist, Bleier & Cox. The action is brought on behalf of all California residents who received a collection letter from Bleier & Cox which failed to include statutorily required information about disputing the validity of the alleged debt. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
In addition to the multiple companies suing Visa and Mastercard over excessive processing fees, two more retail groups announced that they have filed class action suits against Visa USA, MasterCard Inc. and a number of major banks over the fees they charge for processing credit card transactions. The latest cases, filed in the U.S. Court for the Eastern District of New York, were brought by the American Booksellers Association and the National Grocers Association and several of its members, including Affiliated Foods Midwest, Coborn's Inc., D'Agostino's Supermarkets and the Minnesota Grocers Association.
