Class Certification Granted in Sexual Abuse Case Against Roman Catholic Diocese of Covington, KY

The class has been certified in an action filed against the Roman Catholic Diocese of Covington, Kentucky, on behalf of persons who allege that between January 1, 1956, and the present, priests or members of religious orders employed by the Diocese sexually abused them while they were still minors, in violation of Kentucky common law. The action seeks unspecified compensatory and punitive damages. Class members should contact class counsel for more information.

Since October 2003, the diocese has settled 32 individual claims for a total cost of $6.15 million. That includes 24 victims now in the Lexington Diocese, who settled for a total of $4,415,000. Except for one case in Lexington, all of those who settled alleged they had been sexually assaulted as children by various priests. One was an adult in a special circumstance. The claims were apparently settled for an average of less than $200,000 each, and will not affect the class-action, which claims a half-century-long cover-up of sexual abuse by priests and others in the Covington Diocese. So far, 45 priests who molested "hundreds" of victims have allegedly been identified.

For events occurring during the period from 1956 to 1988, the geographic area of the class covers the area of the Diocese as it existed prior to the creation of the Diocese of Lexington in 1988, and includes the following counties: Bath, Bell, Boone, Bourbon, Boyd, Bracken, Breathitt, Campbell, Carroll, Carter, Clark, Clay, Elliott, Estill, Fayette, Fleming, Floyd, Franklin, Gallatin, Garrard, Grant, Greenup, Harlan, Harrison, Jackson, Jessamine, Johnson, Kenton, Knott, Knox, Laurel, Lawrence, Lee, Leslie, Letcher, Lewis, Madison, Magoffin, Martin, Mason, Menifee, Montgomery, Morgan, Nicholas, Owen, Owsley, Pendleton, Perry, Pike, Powell, Robertson, Rockcastle, Rowan, Scott, Whitley, Wolfe, and Woodford.

For the events occurring during the period from 1988 to the present, the geographic area of the class covers the area of the Diocese as it existed after the creation of the Diocese of Lexington in 1988, and includes the following counties: Boone, Bracken, Campbell, Carroll, Fleming, Gallatin, Grant, Harrison, Kenton, Lewis, Mason, Owen, Pendleton, and Robertson.

The court has ordered that the identity of class members remain confidential to the extent possible, and their names are not currently a matter of public record.

A class action lawsuit has been filed in the Los Angeles Superior Court against the Assil Sinskey Eye Institute for violations of the Telephone Consumer Protection Act (TCPA). Class members seek statutory and exemplary damages, restitution and disgorgement of profits derived from "junk fax" solicitation, injunctive relief, attorney's fees and interest.
 
UPC codes are ubiquitous these days— and they are all licensed by the same company. The parties have reached a tentative $3,895,000 settlement in an nationwide action filed against the Uniform Code Council, Inc. on behalf of all persons that paid a membership fee to and acquired a company prefix from UCC prior to August 28, 2002, and to whom UCC mailed an unreturned "renewal invoice" for membership in UCC, or who otherwise paid a renewal fee to UCC. To take part in the settlement, participants must submit a claim form postmarked no later than March 10, 2004.

The parties have reached a tentative $33 million settlement in a class action filed against Bank of America on behalf of trust beneficiaries who allege that Bank of America failed to add it properly reimburse them after it discovered that its subsidiary Security Pacific had overcharged them.
