Texas Employees of AT&T Wireless Claim They Were Denied Overtime Pay

A Collective Action has been filed in Texas against wireless telephone giant, AT&T Wireless Services, Inc. The action, brought under the federal Fair Labor Standards Act, is brought on behalf of all Texas residents employed by AT&T wireless who were not paid overtime wages for all hours worked in excess of 40 per week. The employees allege that AT&T Wireless engaged in intentional and deliberate acts of misconduct aimed at defrauding them of overtime pay. Employees are seeking statutory damages available under federal law as well as back pay and injunctive and declaratory relief.

This action arises out of what employees claim is an intentional and systematic policy of AT&T to deny them proper overtime wages as required under federal law. Under the Fair Labor Standards Act, all employees who are paid by the hour are entitled to receive compensation at the rate of time and a half for all hours worked in excess of 40 per week. According to the employees, AT&T regularly requires them to work beyond 40 per week but skirts the federal requirements
by altering the employees time sheets. The majority of this activity is alleged to have occurred at the Plano, Texas AT&T Wireless call center where managers
are alleged to have forced customer service representatives to work through their breaks without pay in addition to altering their timesheets. Although this action centers around conduct alleged to have occurred at this one facility, all Texas residents who were employed by AT&T Wireless are eligible for this action. As a collective action, all employees who wish to take part must opt-in to the action. The employees have requested that the court give notice to all potential claimants.

A former PricewaterhouseCoopers LLC employee has initiated a class action suit against the Big Four firm claiming unfair pension practices. A national collective action has been filed in Georgia against computer retail giant CompUSA, Inc. The action is brought on behalf of all commercial sales associates who were hired by CompUSA prior to February, 2004. The action is brought under the federal Fair Labor Standards Act and seeks back pay and liquidated damages as well as injunctive and declaratory relief. As a collective action all potential claimants are required to voluntarily "opt-in" to the action in order to be considered a member of the class. The associates have requested that the court issue notice to all potential claimants.
 
A national collective action has been filed in Missouri against IKON Office Solutions, Inc. The action is brought on behalf of all current and former IKON customer service representatives who, since May, 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks compensatory, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A class action lawsuit has been filed in United States District Court for the Eastern District of Pennsylvania against General Fiber Communications, Inc. The case involves violations of federal labor law, specifically the Employee Retirement Income Security Act, which governs employer handling of pension and benefit plans.
