A class action has been filed against Washington state healthcare insurance provider Regence Blue Shield on behalf of female policyholders who allege that they have been denied coverage for FDA-approved forms of contraception, in violation of state insurance and consumer protection laws. The action seeks the out-of-pocket expenses that the women had to pay to purchase contraceptives.
The action alleges that, though Regence covered prescription oral contraceptives, it did not cover all types that have been approved by the FDA. Specifically, the provider did not cover barrier devices such as IUDs and diaphragms, Norplant, Depo-Provera injections, or Lunelle injections, all of which are for use by women alone. The action alleges that Regence forces women into an untenable choice that men do not have to deal with, either paying for expensive contraceptives, taking pills, or getting pregnant.
The proposed class is composed of women who have private health plans and also those who are members of group plans.
