South Carolina Residents Claim National City Mortgage Increased Interest Rate |

A statewide class action has been filed against the National City Mortgage Company on behalf of all South Carolina residents who were issued a mortgage by National City Mortgage that understated the annual percentage rate of interest due to the fact that National City included fees for points and brokerage fees in the amount financed. The action was originally filed in state court, and has been removed to federal court by National City. The mortgagees claim that National City violated the South Carolina Unfair Trade Practices Act and are seeking statutory damages, treble damages and declaratory relief.
This action arises from what the mortgagees allege is a systematic, willful and intentional practice designed to defraud consumers. As part of this scheme, the mortgagees allege, National City included brokerage fees and points in the amount financed by consumers. The mortgagees allege that this increased the amount financed and altered the interest rate--without their knowledge. The mortgagees claim that these fees were actually pre-paid expenses, but were not treated as such. This, the mortgagees allege, is deceptive and misleading and violates the South Carolina Unfair Trade Practices Act.

The action is brought on behalf of all U.S. residents who, since February 2002, have had unauthorized credit report inquiries made by FleetBoston. The action is brought under the federal Fair Credit Reporting Act and seeks actual, statutory
and punitive damages.
A class action lawsuit has been filed on behalf of debtors of Superior Asset Management, Inc. The suit alleges that Affiliated failed to adhere to the requirements of the federal fair debt collection practices act in its interactions with debtors. Additional details will be reported as they become available. Two unsatisfied customers recently filed lawsuits against Cingular Wireless on behalf of themselves and others with the same problem. A class action has been filed on behalf of passengers of American Airlines and its Subsidiaries against American Airlines, AMR Corp. and numerous other travel industry defendants. The case alleges that the defendants disclosed and shared confidential information about the passengers in violation of the Electronic Privacy Act. The case seeks to enjoin further information disclosures and seeks actual and punitive damages on behalf of the plaintiffs. A class action has been filed in Kentucky against the Serban Law Offices and Attorney Daniel Serban. The action is brought on behalf of all Kentucky residents who since October 17, 2002, have received a collection "form" letter from the Serban Law Offices or Daniel Serban. The action alleges that these "form" collection letters do not meet the requirements of the federal Fair Debt Collection Practices Act.
