Female Chevron Phillips Managers Claim Discrimination

A class action has been filed in Texas against petro-chemical giant Chevron Phillips Chemical Company, LP on behalf of all past and present female managers--apparently nationally--of the company who have experienced discrimination based on their sex. The managers claim that Chevron has systematically discriminated against them, violating both federal and Texas civil rights laws. The managers are seeking compensatory damages, back and front pay, injunctive relief and liquidated damages.

This action arises from what female managers at Chevron Phillips call a longstanding policy of discrimination against women in the workforce. According to the managers, female employees are paid less than male employees for identical positions, are not promoted beyond a certain level, are ridiculed and harassed by male employees, are demoted without cause, are provided with less resources to perform their tasks than male employees similarly situated and are often terminated if they raise concerns about the alleged discrimination. The managers claim that not only does Chevron allow this activity to occur, the company actually encourages it. The managers allege that Chevron operates what they refer to as a "Good Old Boy" network with the intention of subjugating and demeaning female employees. Accordingly, the managers claim that Chevron has violated the federal Civil Rights Act of 1964, the federal Equal Pay Act (for paying female employees less to perform identical tasks as male employees) and the Texas Commission on Human Rights Act.

Other Civil Rights Cases of Interest

A statewide class action has been filed in New York against National Asset Management Enterprises, Inc. The action is brought on behalf of all New York residents who, since December 1, 2002, received collection calls from National Asset that allegedly violated the federal Fair Debt Collection Practices Act. The action seeks liquidated damages in the amount of $1000 per class member as well as injunctive and declaratory relief.
 
Federal law prohibits sexual harassment in the workplace. A class action has been filed against business consulting service International Profit Associates, Inc. on behalf of current and former female employees who allege that they were her arrest sexually on the job in violation of federal civil rights laws.
 
A statewide collective action has been filed in Florida against Flood Zone Correction, Inc. The action is brought on behalf of all current and former employees, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A national collective action was filed in Florida on 2/2/2004 against lending giant, Oak Street Mortgage, LLC. The action was brought on behalf of all current and former loan officers, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action was brought under the federal Fair Labor Standards Act and seeks back pay, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. On 5/18/2004, the Magistrate Judge recommended conditionally certifying a class of all loan officers employed by Oak Street at one of its branch offices located in Greenville, South Carolina, Atlanta, Georgia, St. Petersburg, Florida or Ocala, Florida.
