School Employees Seek Back Overtime From Bibb County, Georgia, Board Of Education

A collective action has been filed in Georgia against the Board of Public Education for Bibb County on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay and liquidated damages.

According to employees, the Bibb County School Board has engaged in a systematic and intentional pattern of disregarding federal law in the manner in which it compensates school workers. These workers perform jobs such as assistant coaches, teacher's assistants, cafeteria workers, custodians, bus drivers, bookkeepers, and maintenance workers. They are paid hourly and are not exempt from overtime compensation under the federal Fair Labor Standards Act. The employees allege that in the normal course of their employment, they commonly work well in excess of 40 hours a week. The employees additionally claim that besides often working beyond eight hours in a normal day, they are frequently called upon for special activities, which they claim they are not compensated for.

The workers assert that the board has kept them intentionally misinformed regarding their positions, and this is how they have been able to defraud the workers of overtime pay. The employees also assert that since this pattern has been continuous, all statutes of limitations are tolled--allowing employees to seek compensation for violations that otherwise might have expired. This action is a collective action, and therefore potential class members must opt in to the case. The employees have requested that the court issue notice to all potential claimants.

A class-action suit was filed in the U.S. District Court of Arizona alleging that CareMark Rx, Inc. intentionally concealed revenue in order to avoid paying certain commissions owed to consultants who marketed and sold its services.
 
A class action lawsuit has been filed in the District Court of Connecticut against Mothers Work Inc. for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek damages, costs and attorney's fees.
 
A collective action has been filed in Louisiana against the East Baton Rouge Parish School Board. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by East Baton Rouge. The action is brought under the federal Fair Labor Standards Act and is seeking back pay, statutory and liquidated damages. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered eligible claimants. The employees have requested that the court issue notice to all potential claimants.
