Kash n' Karry Food Stores Settle Gender Discrimination Claims for $1.9+ Million

The parties have reached a tentative $1.9+ million settlement in an action filed against Kash n' Karry Food Stores, Inc. on behalf of all current and former female management and non-management associates of the company who worked at any time between June 10, 1999, and August 22, 2003, in Kash n' Karry's retail operations and completed their 90-day probationary period on or before August 22, 2003. The action alleged that the company implemented policies that prevented women from advancing at the same rates as their male counterparts in violation of the federal Civil Rights Act of 1964. Claims must be postmarked no later than November 21, 2003, to be considered valid.

Approximately 26% of the settlement fund will be utilized to provide discount coupons for current employees and gift certificates for former employees. The rest of the fund will be used to provide cash payments to qualified participants. Payment amounts will be calculated based on a formula that will take into consideration the number of weeks that each claimant worked for the company. Claim forms must be mailed to:

The settlement will not be effective until the court grants it final approval. The court has scheduled a hearing on the matter for December 19, 2003.

A class action has been filed against Wal-Mart for alleged abuses including abuses for off-the-clock work for which employees were never paid, missed meal and rest breaks, and altered time records. The class has a potential for 40,000 members and consists of all current and former hourly employees of Wal-Mart's 35 stores in Washington State from 1995 to present. The class seeks damages, restitution, and injunctive relief.
 
A statewide class action has been filed against the Illinois Department of Corrections and its employee, Michael McManus, on behalf of all past and present female employees of the department who allege they have been discriminated against on the basis of their sex. The employees are seeking compensatory, statutory and punitive damages.
