Kahn Gauthier Swick is investigating possible legal actions against Cordis Corporation on behalf of persons who have been injured by the company's Cypher coronary stent. On October 29, 2003, the federal Food and Drug Administration issued a warning that a significant number of adverse effects had been reported since the Cypher stent was approved on April 24. Both blood clotting and hypersensitivity reactions have been reported.
The FDA announced that it had received more than 290 reports worldwide of thrombosis (clotting) occurring one to 30 days after the procedure to implant the stent. 260 of these reports were from the U.S. In more than 60 of these reports, use of the device was associated with the death of the patient; in the remainder, the device was associated with injury requiring medical or surgical intervention. The FDA has also received more than 50 reports, including some deaths, that may be hypersensitivity reactions. The symptoms include pain, rash, respiratory alterations, hives, itching, fever, and blood pressure changes. The Cypher stent was approved for patients undergoing angioplasty procedures to open clogged coronary arteries. The stent, a cylindrical metal mesh, is designed to keep the arteries from re-clogging after the procedure. It is coated with a thin polymer containing the drug sirolimus that is slowly released into the patient and is intended to reduce the rate of re-blockage that occurs with other stents. As of October 10, 2003, Cordis reports that more than 450,000 Cypher stents have been distributed worldwide, with more than 260,000 of these in the U.S. The FDA does not have enough information to determine whether the incidents of thrombosis and hypersensitivity reaction with the Cypher stent differ from those experienced with bare metal stents. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. A class action lawsuit has been filed in the Northern District Court of Texas against Eyelane, Inc., a Texas optometrist for violations of the Fair Labor Standards Act (FLSA). Class members seek unpaid compensation, attorney's fees, costs and interest. A small number of men have lost eyesight in one eye some time after taking Viagra, Cialis, or Levitra. This type of vision loss is called non-arteritic anterior ischemic optic neuropathy (NAION). NAION causes a sudden loss of eyesight because blood flow is blocked to the optic nerve. A class-action lawsuit recently filed alleges that Medicare has failed to properly enroll millions of low-income seniors and disabled beneficiaries into its new prescription drug plan. The suit, filed in Oakland on behalf of three women and two senior-advocacy groups, also alleges that some low-income beneficiaries eligible for a subsidy were not properly notified about it or not receiving it. As a result of the problems, many seniors and others who qualify for the program are going without critical medication, said lead attorney Jeanne Finberg of the National Senior Citizens Law Center.
