On November 5, 2003, the court granted preliminary approval to the parties' $25 million proposed settlement in a class action filed against Oklahoma's Norman Regional Hospital, a clinic administrator, and nurse anesthetist James Hill who is accused of reusing needles when administering intravenous pain medicine to patients in the hospital's clinic in violation of state medical regulations. The class consists of some 1100 persons who were patients at the hospital.
James Hill worked at the Pain Management Clinic at Norman Regional hospital. Since the investigation into his medical procedures began, 80 patients out of 750 tested have tested positive for Hepatitis C. The hospital only tested patients who were treated between 1999 and 2002. It turns out that Mr. Hill worked at the hospital in the '70s and '80s as well as the 1990s, though he may have been working in a different setting in which the danger was not as great. Mr. Hill started working in the Pain Management Clinic in May 1999, where he was accused of re-using needles up to 25 times per day. He treated patients there until August 2002, when he was accused of malfeasance. The Oklahoma State Nursing Board subsequently revoked Mr. Hill's nursing license and fined him $99,000 after finding that he committed gross malpractice. The settlement will not be effective until the court grants it final approval. The court said it expects to hold a hearing on the matter in December 2003 or January 2004. Bayer AG Accused of Using Anthrax Attacks to Maximize Drug Profits at the Expense of Consumer Safety The terrorist attacks of the past two years have created a time to make big profits as well as a time of uncertainty. A class action has been filed against German drug manufacturer Bayer AG and several New Jersey hospitals on behalf of New Jersey postal workers who allege that they have suffered serious side effects from taking the antibiotic ciprofloxacin (Cipro) in the aftermath of the anthrax attacks in 2001. The action alleges that Bayer failed to warn the postal workers of the potential side effects of Cipro, thereby violating the New Jersey Consumer Fraud Act.
Several class actions have been filed against biotechnology company Thoratec Corporation (Nasdaq:THOR) and certain of its officers and directors by stockholders who purchased the company's common stock between April 28, 2004, and June 29, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. A recent $690 million dollar settlement has been announced for certain Zyprexa claimants.
