Kentucky Residents Angry Over "Form Letter" Collection Attempts |

A statewide class action has been filed in Kentucky against the Serban Law Offices and attorney Daniel Serban under the federal Fair Debt Collection Practices Act (FDCPA). The action is brought on behalf of all Kentucky residents who since October 17, 2002, have received a collection "form" letter from the Serban Law Offices or Daniel Serban. The class members allege that these "form" collection letters do not meet the requirements of the FDCPA. The class members are seeking statutory damages available under the FDCPA.
This action arises from what class members assert are patently unlawful attempts to collect debts by the use of generic "form" letters. The class members assert that the letters are not actually mailed by the defendants, but from a private mailing operation. These letters, according to class members, are deceptive and violate the FDCPA because they lead consumers to believe that an attorney has reviewed the status of their debt and determined that it is appropriate to take collection action. According to the class members, the letters are not signed by Mr. Serban or anyone from his law office and the letters simply use the name of Mr. Serban's office to intimidate consumers into paying the alleged debts.
Under the FDCPA it is unlawful to send a letter or communication that states it is from an attorney or law firm, when it is not. It is also unlawful to represent that an attorney reviewed a debt, when he or she in fact, did not. Collecting a debt using any false representations is also forbidden under FDCPA. These types of violations entitle consumers to statutory damages under the FDCPA. The class members assert that Mr. Serban and his law office have been engaging in these unlawful and fraudulent activities for quite some time and that the violations number in the thousands.

A West Virginia woman has filed a class action lawsuit against Capital One Bank, accusing the company of violating the Fair Debt Collection Practices Act.
Earlene West of Gandeeville filed the lawsuit on Nov. 16 in U.S. District Court. She alleges in her lawsuit that Capital One acquired several charged-off credit card accounts from Providian, including her own. A class action has been filed against Transunion, a credit reporting agency, by Steven and Melody Millett after Steven’s Social Security number was stolen and used by another individual over the course of 13 years. The Milletts claim that Transunion should have known that the Social Security Number was being used by more than one person and that upon being notified of the error, should have corrected their error. The lawsuit alleges negligent misrepresentation, fraud and failure to comply with the Fair Credit Reporting Act and seeks damages and injunctive relief. A class action lawsuit has been filed in federal court against California mortgage lender Ameriquest Capital Corporation. The case involves violations of federal fair credit reporting laws. It appears from documents filed with the court that the case may be assigned to an alternative dispute resolution program in an effort to expedite a settlement. Class members seek an injunction specifying that the defendant cease communication with her, damages, reasonable attorney’s fees and cost of the litigation.
