Miami-Dade County Residents Accuse BellSouth of Overcharging for Repair Fees

A class action has been filed against BellSouth Corporation on behalf of Miami-Dade County, Florida, customers who allege that the company has been collecting excessive fees from Miami-Dade County customers to cover the cost of posting security guards while it performs repairs underground in manholes, in violation of a county ordinance. The action seeks unspecified compensatory damages.

The action alleges that the telephone company is charging each residential and business customer eleven cents per line per month to cover the cost of the security guards. The action requests that the court certify a class of all BellSouth customers in Miami-Dade County from July 1999 through at least mid-July 2003.

A Miami-Dade County ordinance does require that all companies working in manholes have a second person above ground for safety and security purposes. BellSouth allegedly contracts with security firms to provide an above-ground security guard while the BellSouth repair technician goes underground.

A class action has been filed on behalf of California residents against Cingular Wireless claiming that the company failed to adequately disclose its practice of charging consumers multiple times for the same airtime minute of cell phone use. The action is titled Paton v. Cingular Wireless, et. al., No. 428855, and is pending in the California Superior Court for the County of San Francisco.
 
The parties have reached a tentative settlement in several consolidated class actions filed against electric power generation systems developer Plug Power, Inc. (Nasdaq:PLUG) and certain of its officers and directors by stockholders who purchased the company's common stock between February 14, 2000, and August 2, 2000. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. There are widespread allegations that the cellular phone industry uses hidden, illegitimate charges to broaden its profit margins. The parties have reached a proposed settlement of a national class action against Nextel Communications, Inc. and related companies on behalf of customers who allege that the company bills a "Federal Programs Cost Recovery" fee of $1.55 per month in violation of state consumer protection law and in breach of Nextel's contract with the customers.
 
Federal law prohibits the use of fax machines for sending unsolicited advertisements. The class has been certified in a class action filed against car wash company Carnett’s, Inc. on behalf of up to 73,500 persons who received advertisements over their fax machines in violation of the federal Telephone Consumer Protection Act. The action seeks between $500 and $1500 damages per fax sent as allowed by the Act. All persons who received such an ad should contact attorneys for the class.
