Federal Trade Commission Settles With Credit Card Scammer ClickForMail.com for $815,000

The parties have reached an $815,000 settlement in an enforcement action filed against ClickForMail.com, Inc., doing business as AllPreApproved.com, and Harvey B. Vaughn, III, on behalf of consumers who were targeted in an e-mail scam that promised major, unsecured credit cards with credit limits up to $5,000 for an advance fee of $49.95 in violation of the Federal Trade Commission Act. Persons who paid money under this scheme should contact the Federal Trade Commission for information about participating in the settlement.

ClickForMail.com was caught in part of the Federal Trade Commission's Southwest Netforce sweep that targeted Internet scammers and deceptive spammers. The commission alleged that consumers who paid the fee did not receive the credit card they were promised. Instead, they allegedly received access to a set of hyperlinks to companies where consumers could apply for credit cards, and even then those were generally for secured credit cards, stored-value cards, or catalog charge cards.

Allegedly, ClickForMail promised that: (1) consumers who met minimum qualifying criteria and paid a $49.95 fee were guaranteed to receive unsecured major credit cards or get a 200% refund of their money; and (2) ClickForMail had special arrangements with banks or financial institutions to issue to its customers unsecured major credit cards.

Other Credit / Debt Cases of Interest

A statewide class action has been filed in Pennsylvania against Irv Borenstein, Esq. A class action lawsuit has been filed in the Southern District Court of Indiana against Diversified Collections Services, Inc. for violations of the Fair Debt Collection Practices Act (FDCPA) which prohibits debt collectors from engaging in abusive, deceptive and unfair collection practices. Class members seek statutory damages, reasonable attorney’s fees and costs of the litigation.
 
A South Carolina consumer filed a class-action lawsuit against the three national credit bureaus, charging that they allow a practice that lowers millions of individuals' credit scores.
 
A class action covering California and New York has been filed in New York against collection specialists Forster & Garbus. The action is brought on behalf of all California and New York residents who received form type collection letters from Forster & Garbus which offered to settle the consumers' alleged debt for a lesser amount. The action is brought under the federal Fair Labor Standards Act and seeks statutory damages as well as injunctive and declaratory relief.
 
Two New Jersey law firms filed a complaint against Bank of America on June 1, 2005 in New Jersey Superior Court, Mercer County on behalf of Trenton resident Cindy Jones. The attorneys announced their intention to seek class action status to represent other identity theft victims as well against financial services giant Bank of America for damages resulting from the theft of tens of thousands of customer information files.
 
A class action lawsuit has been filed in the Eastern District Court of New York against Credit Collection Services, Inc., a New York based collection agency, for violations of the Fair Debt Collection Practices Act (FDCPA) which prohibits debt collectors from engaging in abusive, deceptive and unfair collection practices. Class members seek damages, attorney's fees and costs of the litigation.
