Customers Of Latin Shopping Television Network Allege Fraud

A class action has been filed in federal court alleging that the Latin Shopping Television Network and its parent company, the Crediamerica Group, have been systematically preying on and defrauding customers. The action is brought on behalf of all customers who have bought merchandise from either company since their formation (believed to be about January 1, 2000) and who did not receive it at all, within a reasonable time period, or as promised to the customer.

The complaint alleges a practice in which the shopping network advertises and sells items that are not in stock, and possibly will never be in stock. Allegedly, attempts to inquire about the status of paid-for orders are brushed off and requests for refunds are denied. The action seeks compensatory damages, declaratory and injunctive relief, punitive damages, and attorney's fees.

The Latin Shopping Television Network is composed of both a television sales channel that is carried nationally and an Internet website that is available to customers the world over. Appealing primarily to customers who are Hispanic or Latino, the network advertises merchandise, such as computers, satellite television systems, etc. for sale. According to the customers' allegations, the network targets people who have a limited ability to speak English and who have almost no knowledge of the American legal system.

It is claimed that the merchandise sold to the class members is rarely, if ever, in stock. Additionally, bait-and-switch tactics are allegedly utilized to encourage consumers to buy more expensive items than the ones advertised for sale. Once the item or items are paid for, they are allegedly rarely delivered. Calls and other attempts to obtain information about the status of purchases are deflected with the promise that the items are on order and will be delivered soon. Attempts by class members to obtain refunds for items never delivered are apparently fruitless, with the shopping network stating that it is "not their policy" to issue refunds.

The action contends that the shopping network's conduct is fraudulent and deceptive, a violation of the class members' civil rights under federal and state law, a violation of consumer protection laws and a violation of federal anti-racketeering laws.

A class action has been filed against karaoke equipment maker The Singing Machine Company, Inc. (AMEX: SMD), certain of its officers and directors, and its auditor, Salberg & Company, P.A., by stockholders who purchased the company's common stock between August 9, 2001, and June 27, 2003.
 
All of those miscellaneous charges that companies add on to credit purchases are regulated by state and federal law. The parties have reached a tentative settlement in a class action against Schewel Furniture Company, Inc. on behalf of all Virginia residents to whom the company improperly applied finance charges, thereby violating Virginia's Consumer Protection Act and the federal Truth in Lending Act.
 
A national class action filed against health and beauty company Avon Products, Inc., on behalf of independent sales representatives, has been revived by an appellate court after being dismissed by the Los Angeles County Superior Court. The lawsuit alleges that Avon artificially boosted its financial performance by "channel stuffing " -- forcing independent sales representatives to pay for unordered products even after the shipments are returned to Avon, in violation of California unfair competition and business practices laws.
 
Several class actions have been filed against Italian dairy giant Parmalat Finanziaria S.p.A (Pink: PARAF.PK, formerly OTCBB: PARAF) and certain of its officers and directors by stockholders who purchased the company's common stock between January 5, 1999, and December 29, 2003. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
 
Kahn Gauthier Swick is investigating possible legal actions on behalf of persons harmed by exposure to asbestos. It is estimated that half a million legal actions have been filed to recover for injuries and deaths resulting from asbestos.
 
A Prairietown, Illinois man filed a class action complaint against Sealy Mattress and Famous Barr because they refused to replace his sagging, stained bed. David Rook filed the lawsuit Feb. 18, 2005, alleging that the manufacturer and retailer refused to honor an "anti-sag" warranty to replace his bed because it had a stain.
