Georgia Light Cigarette Smokers Want Philip Morris USA to Return Money

A class action has been filed against cigarette maker Philip Morris USA, Inc. on behalf of all persons who purchased Philip Morris "Light," "Ultra-Light," or "Low-Tar" cigarettes in Georgia for personal consumption but who do not have any claims for personal injuries resulting from the purchase or consumption of cigarettes. The action alleges that the company deceived smokers into believing that light cigarettes were safer than other brands in violation of state consumer protection laws. The action seeks a return of all money that consumers paid for the purchase of Philip Morris light cigarettes.

The action alleges that the company intentionally conveyed a clear message to consumers that "Light," "Ultra-light" and "low-tar" cigarettes posed a decreased health risk when they actually deliver higher tar and nicotine levels than regular cigarettes. This action comes on the heels of a recent $10.1 billion judgment in Madison County, Illinois. Attorneys in the Georgia action attached the Illinois judge's 51-page order to their petition for damages. In that Illinois order, the judge ruled that Philip Morris intentionally marketed Marlboro Lights and Cambridge Lights as less harmful products than regular cigarettes, as "health reassurance cigarettes in that they expressly and impliedly conveyed the notion of a positive health attribute" through the use of the terms light and lowered tar.

The action alleges that Philip Morris marketed "Light," "Ultra-Light," and "Low-Tar" cigarettes as containing reduced levels of tar and nicotine even though scientific studies had already revealed that the tar and nicotine levels found in them correlated to a significantly increased risk of developing smoking-related diseases. The cigarettes in question allegedly were designed so that they would generate reduced tar and nicotine levels when tested on the Federal Trade Commission's Cambridge Filter System, even though they produced much higher levels when actually smoked by a person.

Philip Morris USA brands include Marlboro, Virginia Slims, Benson & Hedges, Merit, Parliament, Alpine, Basic, Cambridge, Bristol, Bucks, Chesterfield, Collector's Choice, Commander, English Ovals, Lark, L&M, Players and Saratoga. A number of these brands have light or ultra-light versions.

An administrative proceeding has been filed by the Federal Trade Commission against Boston-area marketers Direct Marketing Concepts, Inc., ITV Direct, Inc., along with business partners Healthy Solutions, LLC, and Health Solutions, Inc., Triad ML Marketing, Inc., and King Media, Inc., on behalf of all persons who purchased the dietary supplements “Supreme Greens with MSM” and “Coral Calcium Daily.” The action alleges that the companies falsely promoted the supplements as a means to treat, cure, and prevent cancer and other diseases, and to cause significant weight loss, in violation of the federal FTC Act.
 
Several class actions have been filed against fast food giant McDonald's Corporation (NYSE:MCD) and certain of its officers and directors by stockholders who purchased the company's common stock between December 14, 2001, and January 22, 2003. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
Rewards Network Inc., which provides marketing services and loyalty programs to the restaurant industry, reached a preliminary agreement to settle a class action lawsuit brought against the company in California for up to $28 million.
 
CCC Information Services Inc., a subsidiary of CCC Information Services Group Inc. announced July 13, 2005 it and 15 of its customers signed a settlement agreement with the plaintiffs in various class action suits pending in Madison County, Illinois. The consolidated suits relate to the valuation of vehicles that have been declared total losses by insurers.
 
Bankrupt Enron Corporation lost a round in court when a judge refused to dismiss a class-action lawsuit against its Portland General Electric subsidiary. The lawsuit seeks $7 million that PGE charged ratepayers for taxes the complaint alleges were not paid to Multnomah County.
 
Home improvement is a booming industry throughout the United States. A class action has been filed against home improvement retail chain The Home Depot, Inc. on behalf of Californians who allege that the company requires customers to make excessive down payments on home improvement projects, in violation of the California Home Improvement Bill of Rights.
