Nextel Customers are Tired of Paying Hidden Fees

The parties have reached a proposed settlement of a national class action against Nextel Communications, Inc. and related companies on behalf of customers who allege that the company bills a "Federal Programs Cost Recovery" fee of $1.55 per month in violation of state consumer protection law and in breach of Nextel's contract with the customers. The action alleges that these charges were not referred to by Nextel at the time of purchase and are imposed unilaterally by the company. Under the settlement, class members will receive free minutes.

Nextel's practices are part of a new trend in the wireless telecommunications industry--the addition of surprise charges to customer bills that add substantial amounts over the life of the contracts. In many cases, these charges are being added to deals that were allegedly advertised as fixed prices for bundles of minutes. Because the charges pose as taxes, many consumers assume that they are above-board.

The settlement will not be effective until the court grants it final approval. The court has scheduled a hearing on the matter for January 29, 2004.

Other Technology Cases of Interest

The parties have reached a settlement apparently valued at approximately $56 million in a class action filed against SBC Communications, Inc., on behalf of current and former voicemail customers in SBC's Midwest region, who alleged that the company misled them by not adequately disclosing the service's true charges. The settlement covers residential and business customers who have subscribed to voicemail with SBC, Ameritech, Illinois Bell Telephone Company, or any of the other Bell companies in SBC's Midwest region (Illinois, Indiana, Michigan, Ohio, and Wisconsin). Claim forms must be postmarked no later than September 1, 2004, to be considered valid.
 
A class action has been filed in the Central District Court of California against Hienergy Technologies, Inc., a California based chemical technology company, (HIET.OB), and certain of its officers and directors by stockholders who purchased the company's common stock between February 22, 2002 and July 8, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
 
The telecom market has had its ups and downs. A class action has been filed against telecommunications company Allegiance Telecom, Inc. (OTC:ALGXQ) and certain of its officers and directors by stockholders who purchased the company's common stock between April 24, 2001, and February 19, 2002. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
Several class actions have been filed against networking company Netopia, Inc. (Nasdaq:NTPA), and certain of its officers and directors by stockholders who purchased the company's common stock between November 6, 2003 and July 6, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
On September 6, 2005, the Court dismissed several class actions that had been filed against electronic design automation software maker Synopsys, Inc. (Nasdaq:SNPS), and certain of its officers and directors by stockholders who purchased the company's common stock between December 3, 2003, and August 18, 2004. The actions claimed that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
Federal securities laws and regulations protect innocent stockholders from unfair dealing by powerful corporate figures. The parties have reached a tentative $11 million settlement of several class actions filed against electronic data interchange provider Envoy Corporation (formerly Nasdaq: ENVY) and certain of its officers and directors by stockholders who purchased the company's common stock between February 12, 1997, and August 18, 1998. To recover under the settlement, a completed proof of claim postmarked no later than February 20, 2004, must be mailed to the claims administrator.
