Mitsubishi Motor Manufacturing Hit With Repeat Racial Discrimination Action Alleging that 2001 Settlement Failed to Fix Problems at Normal, IL Plant

A class action has been filed against Mitsubishi Motor Manufacturing of America, Inc., on behalf of black and Hispanic employees at the company's Normal, IL, plant who allege that Mitsubishi has continued to allow a hostile work environment to exist even after a prior racial discrimination action was settled for $3.2 million in 2001. The action further alleges that Mitsubishi has retaliated against these employees because of the earlier settlement, and that the company's conduct violates federal and state civil rights laws. The action seeks compensatory and punitive damages, and yet another order that will force the company to see that the work environment provides an equal playing field for all workers.

The action alleges that discrimination similar to that which prompted the 2001 lawsuit is happening again. Named plaintiffs Bobby Fields, Craig Montgomery, Victor Ramirez, Scott Smomolar, Darrell Thompson, Victoria Withers and Jeffrey Woodward allege that they were: (1) The targets of racially derogatory and disparaging remarks; (2) forced to perform jobs for which they were not trained; (3) required to perform work that medical restrictions prohibited; (4) denied requests for time off; (5) subjected to unwarranted disciplinary action; (6) physically and emotionally abused; and (7) victims of property destruction, all because of their race, color, or national origin. The action alleges that the employees were subject to so much emotional abuse that they required prescriptions for antidepressants, therapy and time off work.

This action is one of many filed in the past decade alleging some form of discrimination at Mitsubishi's facilities. This action is similar in language and nature to a 1996 claim brought by the U.S. Equal Employment Opportunity Commission, which sued the automaker on behalf of more than 300 women who alleged they were groped and subjected to lewd jokes and behavior. That action eventually resulted in a $34 million settlement for the women. The company also paid an additional $9.5 million to 27 women who pursued their claims outside the class action.

The action alleged that the officials violated the federal Employee Retirement Income Security Act by obtaining and retaining WorldCom stock in the company's 401(k) plans even though they knew of WorldCom's financial problems. A class action lawsuit has been filed in U.S. District Court for the Southern District of Florida against Discount Auto Parts, Inc. The case involves violations of Federal Labor law. No additional information about the substance of the allegations is available at this time. A class action lawsuit has been filed in the Northern District Court of Georgia against Medquist, Inc., a New Jersey based provider of electronic medical transcription, health information and document management services, alleging fraud, breach of contract, demand for accounting, unjust enrichment, negligence, negligent supervision, and Racketeer Influenced and Corrupt Organizations (RICO). Class members seek compensatory damages, punitive damages and restitution.
 
Federal civil rights legislation prohibits discrimination based on gender, age, race, or national origin. A class action has been filed against real estate services company CB Richard Ellis, Inc. on behalf of current and former female employees who allege that the company created a hostile work environment when it allowed male employees to sexually harass them in violation of Title VII of the 1964 federal Civil Rights Act.
 
California labor law requires employers to ensure that their workers take meal breaks. The class has been certified in an action filed against Wal-Mart Stores, Inc. on behalf of current and former Californian hourly employees who worked any time from February 6, 1997, through the date that judgment is entered in the action, excluding employees who held managerial or pharmacist positions. The action alleges that the company engages in systematic denials of rest and meal breaks to workers, and forces them to work off the clock before and after they actually clock in, violating California's labor and unfair competition laws.
