California Junk Fax Recipients Say NO to Unsolicited Facsimiles

Two related class actions have been filed against numerous companies that send unsolicited faxes on behalf of Californians who allege that the unsolicited junk faxes were sent in violation of the federal Telephone Consumer Protection Act (TCPA). The actions seek actual monetary damages, or statutory damages of $500 per violation and $1,500 for each willful violation.

The TCPA was enacted in 1991 in a climate of widespread concern about the costs associated with unsolicited fax advertisements and the limited ability of the states to deal with the problem. In 1991, two states had enacted measures to regulate intrastate junk faxes, and similar bills were pending in about half the states. But only the federal government, with its power to regulate interstate telephone calls, could enact a national solution.

The TCPA is enforceable in federal court by state attorneys general. But the states have exclusive jurisdiction over the conditional private right of action created by the statute. To date, Texas is the only state that prohibits private citizens from bringing actions under the statute. Senator Ernest F. Hollings, the TCPA's sponsor, expressed hope that this provision would make it easier for consumers to sue, preferably in small claims court without having to pay for a lawyer.

One of the actions alleged that a software company used the telemarketing services of DataMart Information Services Corporation to send 13,919 unsolicited taxes to 8,216 recipients in 1998 and 1999. The other action alleges that two telemarketers--Fax.com, Inc. and Cynet, Inc.--had sent 728,776 unsolicited fax advertisements to businesses and consumers in Southern California in June 2000.

Initially, the trial court dismissed the actions, ruling that California law did not allow private citizens to bring actions under the TCPA. When the fax recipients appealed the decision, the appeals court reinstated the actions and ruled that California law did not prohibit private class actions that are brought under the TCPA.

The parties have reached a tentative $12.4 million settlement in a class action filed against Ameritech Corporation (now a subsidiary of SBC communications, Inc.) on behalf of Illinois residents who signed up for Ameritech's "SimpliFive" local calling plan, which ended up costing more money for nearly half of those who participated. Microsoft has laid yet another antitrust action to rest--there are at least six more to go. The parties reached a tentative $32 million settlement in a class action against Microsoft Corporation alleging that Microsoft violated Kansas' antitrust and unfair competition laws. The proposed settlement benefits consumers and businesses who, between December 10, 1996, and December 31, 2002, resided in Kansas and indirectly purchased certain Microsoft operating system, productivity suite, spreadsheet or word processing software for use in Kansas and not for resale.
 
Semiconductor technology changes very rapidly—cutting edge companies are developing faster and better materials and designs constantly. Several class actions have been filed against semiconductor wafer manufacturer IBIS Technology Corporation (Nasdaq: IBIS) and certain of its officers and directors by stockholders who purchased the company's common stock between October 2, 2003, and December 12, 2003. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
A class action has been filed against high tech manufacturer Remec Incorporated (Nasdaq: REMC) and certain of its officers and directors by stockholders who purchased the company's common stock between September 8, 2003 and September 8, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
 
The parties have reached a settlement valued at $9.7 million in a class action filed against Microsoft Corporation on behalf of consumers who, between March 31, 1995, and December 31, 2002, resided in Vermont and indirectly purchased Microsoft operating system, productivity suite, spreadsheet, or word processing software for use in Vermont. The action alleged that Microsoft violated Vermont’s consumer fraud act by illegitimately using its monopoly power. Persons eligible to take part in the settlement may contact attorneys for the class for more information.
 
Several class actions have been filed against software company Quovadx, Inc. (Nasdaq:QVDX) and certain of its officers and directors by stockholders who purchased the company's common stock between October 22, 2003, and March 15, 2004. The actions claim that the defendants iolated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
