Hospital Patients Allege They Were Tricked into Consenting to Filming of "Trauma: Life in the ER"

A national class action has been filed against New York Times Television, its parent The New York Times, and several other media companies on behalf of thousands of hospital patients who have appeared in the television reality show, "Trauma: Life in the ER," alleging that company representatives committed fraud by tricking the patients into giving consent for filming. The action seeks unspecified compensatory and punitive damages.

The named plaintiffs in the action are Monmouth County, New Jersey, residents Michael Castro, who was stabbed, and Julio Costa, whose hand was severed in an accident. They were filmed in July 2001 for "Trauma: Life in the ER." Allegedly, Jersey Shore Medical Center and New York Times Television crewmembers working for the television show lied to the patients that the filming was to be used only for doctor training. The action alleges that the TV show has grossed hundreds of millions of dollars this way by exploiting emergency room hospital patients who are typically vulnerable and who are paid nothing for being subjected to intrusions into their private, intimate affairs.

Mr. Castro was allegedly approached by someone in medical scrubs trying to pass himself off as a medical professional, and tried to get Castro to sign an appearance consent and release. He asked that he not be filmed, but five days later after repeated requests and assertions that the film would be used only for training purposes, he signed the form. He also told the companies he didn't want certain private details aired. A year and a half later, a work colleague allegedly approached him and said, "I heard your wife tried to kill you." "Unbeknownst to Mr. Castro the show had just aired on national television. Other plaintiffs allegedly had similar experiences, including one identified as Jane Doe whose AIDS treatment was featured on one of the installments.

The unauthorized release of patient information has recently been an issue of growing concern nationally. Even before recent revisions strengthening the privacy provisions of the federal Health Insurance Portability and Accountability Act of 1996, patient bills of rights in many states required great care before unauthorized release of patient information. The issue of valid consent prior to filming would seem to fit snugly into this niche.

A class action lawsuit has been filed in the Eastern District Court of Pennsylvania against Glaxosmithkline, PLC for violations of antitrust laws. Class members seek damages, other monetary relief, equitable relief, attorney's fees and costs of the litigation.
 
On June 24, 2005, The U.S. Supreme Court handed a victory to 11,000 small gas station owners in the longstanding class action battle against ExxonMobil Corp. The case centered on Exxon's August 1982 discount-for-cash program, which promised station owners a price cut for gas to offset a new credit card fee the oil company was charging them. The station owners alleged that Exxon, which later merged with Mobil, eliminated the price discount seven months later, yet for years continued to tell stations that it was providing the discount.
 
The class has been certified in an action filed against the Roman Catholic Diocese of Covington, Kentucky, on behalf of persons who allege that between January 1, 1956, and the present, priests or members of religious orders employed by the Diocese sexually abused them while they were still minors, in violation of Kentucky common law. Class members should contact class counsel for more information.
 
The parties have reached a tentative $8 million partial settlement in an action filed against AMF Bowling, Inc. (Pink Sheets: AMBWQ.PK) and certain of its officers and directors by stockholders who purchased the company's common stock pursuant to the registration statement for the November 1997 initial public offering before February 26, 1999. The action continues against the remaining institutional defendants. Proof of claim documents must be postmarked on or before October 29, 2004, to be considered valid.
