Philadelphia-Area African American Professional Sunoco Employees Allege Racially Discriminatory Promotion Practices |

A class action has been filed against petroleum company Sunoco, Inc. on behalf of current and former salaried non-union professional African American employees employed within the Philadelphia area at any time during the period from January 1, 1996, to the present, in violation of Title VII of the federal 1964 Civil Rights Act. The action seeks unspecified compensatory and punitive damages, and a court order barring racial discrimination and retaliation by Sunoco, requiring the company to adopt policies and practices that ensure equal treatment of all black employees and applicants, and requiring it to eliminate opportunities for managers to discriminate on the basis of race.
The action was filed by seven current and former African American Sunoco employees, all of whom allege that Sunoco's advancement and promotion practices resulted in fewer opportunities for African Americans when compared with their white counterparts. The trial court granted class certification on July 11, 2003, finding that the statistical evidence of discrimination presented by the plaintiffs' expert, Dr. Janice F. Madden, provided a sufficient basis for the certification request.

A statewide class action has been filed in Pennsylvania against Irv Borenstein, Esq. This action is brought on behalf of all Pennsylvania residents who, since December 5, 2002, have received a letter from Borenstein's law firm in an attempt to collect a debt. Consumers allege that certain language contained in the letters sent by Borenstein violate the federal Fair Debt Collection Practices Act and are seeking unspecified compensatory damages, statutory damages and injunctive and declaratory relief. A statewide collective action has been filed in Florida against Cingular Wireless, LLC. The action is brought on behalf of all current and former inside sales associates, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. Fifty-one Round Rock High School students are suing the city of Round Rock and the Round Rock Independent School District over arrests at immigration protests in March 2006. A Charlottesville man has filed a federal class-action lawsuit on behalf of himself and other local black men asked by police to submit to DNA testing in the hunt for the serial rapist that has been forensically linked to at least seven attacks between 1997 and 2004.
