Recent East Coast Grads Settle Failed Job Offer Action With PricewaterhouseCoopers for $1.8 Million

On August 1, 2003, the court granted final approval to the parties' $1.8 million settlement in an action filed against accounting firm PricewaterhouseCoopers on behalf of recent college graduates who alleged they were recruited to work for the company with promises of signing bonuses that they never received, and were never even hired, defrauding them and violating the contracts they had made with the company in good faith. Persons who think they are eligible to take part in this settlement should contact the attorneys that represent the graduates as soon as possible.

The action alleged that recruiters working for PricewaterhouseCoopers and assigned to major colleges and universities in the eastern United States made written offers of employment to students slated to graduate in spring 2001. The company allegedly offered entry-level management consulting positions in East Coast offices at a starting annual salary of $52,000 or higher. Graduates who accepted the positions were to undergo an intensive training program. The action alleged that PricewaterhouseCoopers also offered $3,000 bonuses to those who accepted the job offers plus another $4,000 bonus for those who accepted before a deadline of a few weeks.

The graduates alleged that after accepting the company's job offer, they stopped looking for other jobs, turned down job offers from other companies, and incurred expenses in preparing to begin work for PricewaterhouseCoopers. Some even allegedly moved to the cities where they expected to begin working. As the economy declined in 2001, the recruiters allegedly made repeated assurances to the graduates that the jobs were secure.

A collective action has been filed in Alabama against the Oxford City Board of Education on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as damages.
 
A statewide collective action has been filed in West Virginia against credit card customer service giant, Applied Card Systems, Inc. The action is brought on behalf of all West Virginia employees of Applied who were not paid proper overtime compensation for all hours worked beyond 40 per week and who were terminated suddenly on April 23, 2003, when Applied closed its West Virginia operations without prior notice to employees. The action is brought under the federal Fair Labor Standards Act and West Virginia labor laws and seeks back pay, statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants must voluntarily "opt-in" to the action in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants.
 
An $18+ million class action has been filed against the Mayo Foundation and its subsidiary clinics in Arizona, Minnesota, and Florida on behalf of employees who allege that the health provider's method for paying salaried workers shorts employees while netting the company millions of dollars in violation of state labor laws.
 
A class action has been filed against MSC Development, Inc., (MSC), a cosmetic teeth whitening company in Fort Worth, Texas and its President and Director, by a former employee who alleges that she was not paid overtime hours according to the Fair Labor Standards Act (FLSA).
