TRW Automotive U.S. Reaches $2.3 Million Settlement in Michigan/Indiana Racial Discrimination Action

The parties have reached a tentative $2.3 million settlement in a class action filed against automobile parts manufacturer TRW Automotive U.S., LLC, on behalf of certain current and former African American employees at TRW's plant in Portland, Michigan, or its Lafayette or Lebanon, Indiana, facilities who allege that the company discriminated against them in promotions, compensation, training, and other employment practices in violation of federal civil rights laws between January 1, 1995, and July 23, 2003. Eligible claimants should contact the class attorneys as soon as possible regarding the settlement.

The action alleged that TRW discriminated against those African American employees and subjected them to a hostile environment at their workplaces. Under the terms of the settlement, TRW will pay 15 named plaintiffs in the case a total of $450,000, and establish a class fund of $1.35 million. Eligible employees--estimated to number about 200--will receive up to $90,000 each, depending on the merit of their claims, which are to be determined by a special master selected by the parties.

In addition to the monetary portion of the settlement, TRW has agreed to spend $500,000 over the next three years to improve its diversity and equal employment opportunity training program at its Lebanon facility, provide an annual report on race-based harassment or discrimination complaints to the plaintiffs' counsel for three years, issue a specific anti-harassment policy, and post salaried job openings. TRW has also agreed to propose to the United Auto Workers union that a panel be created to evaluate race-based complaints and that a holiday be established in honor of Martin Luther King, Jr.

According to the complaint, AMH was to only charge Honke reasonable and customary rates for healthcare services and he would only be obligated to pay reasonable charges for the services he received.
 
Federal civil rights laws prohibit discrimination based on gender, age, race, and national origin. On August 4, 2003, the court granted final approval to the parties' $1.5 million settlement in an action filed against Colorado Central Station Casino operator Anchor Coin, Inc. on behalf of Hispanic employees who allege that they were verbally harassed and subjected to "English-only" rules in violation of Title VII of the 1964 Civil Rights Act. The casino is in Black Hawk, Colorado. Eligible claimants should contact the EEOC for further information.
 
The parties have reached a tentative $538,000 settlement in a class action filed against clothier The Gap, Inc. on behalf of African-American employees who were employed at the Gap's Gallatin, Tennessee, campus between October 7, 1999, and September 12, 2003. The action alleged that they were discriminated against in violation of the federal Civil Rights Act of 1964 and the Tennessee Human Rights Act. Persons eligible to participate in the action should contact the class attorney for more information.
 
A national collective action has been filed in Florida against Morgan Tire & Auto, Inc. The action is brought on behalf of all current and former Managers, Assistant Managers and Managers in Training who were improperly classified as exempt employees and not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damage and back pay as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
According to four employees, C&S Wholesale Grocers, Inc., the nation's 8th largest privately held corporation, routinely cheats thousands of its piece-rate warehouse workers out of millions of dollars in weekly wages. The four employees filed a nationwide class action in U.S. District Court for the Southern District of New York. The workers seek $750 million from C&S in unpaid wages and overtime under the Federal Fair Labor Standards Act and state labor laws in each of the 14 states where the company operates warehouses. The case applies to workers who have been employed by C & S since 2000.
 
A collective action has been filed in Louisiana against the St. John the Baptist Parish School Board. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by St. John. The action is brought under the federal Fair Labor Standards Act and is seeking back pay, statutory and liquidated damages. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered eligible claimants. The employees have requested that the court issue notice to all potential claimants.
