Nissan and Infiniti Florida Lease Holders Upset Over Hidden Fees for Wear and Tear and Excessive Mileage

A Florida class action has been filed against auto financing companies Nissan Motor Acceptance Corporation and Infiniti Financial Services, on behalf of vehicle lessees who allege that the companies charged them "taxes" that were actually just undisclosed fees to cover wear and tear, and excess mileage on the vehicles, in violation of Florida consumer protection laws and the federal Consumer Leasing Act. The action seeks unspecified compensatory damages.

Though the action is currently restricted to Floridians who have leases with Nissan Motor Acceptance Corporation and Infiniti Financial Services, or whose lease with the companies expired in the last year, the attorneys who filed this action are interested in hearing from persons who lease or have leased vehicles in other states as well. State "lemon laws" are designed to protect consumers who have purchased a vehicle that turns out to be so defective that numerous attempts to fix all its problems are insufficient. A class action has been filed against the nation's three leading automobile manufacturers on behalf of Ohio residents who leased or purchased an automobile from Ford Motor Company, DaimlerChrysler Corporation, or General Motors Corporation and who, after going through the Ohio Lemon Law Dispute Resolution Board, had a "reasonable use" charge deducted from the refund that they received.
 
The class has been certified in a nationwide action filed against DaimlerChrysler Corporation on behalf of all owners of 1996 and 1997 Chrysler Town & Country’s, Chrysler Minivans, Plymouth Voyagers, Plymouth Grand Voyagers, and Dodge Caravans, who allege that the front-passenger airbags in these vehicles deploy with excessive force in low-speed accidents, possibly injuring children or small adult passengers.
 
A class action has been filed against the Washington state Department of Licensing on behalf of state drivers whose licenses were suspended through the mail, who allege that their right to due process of law has been violated since they have no opportunity to contest potential errors. The action seeks unspecified compensatory damages.
 
Sometimes defects in automobiles show up only after months of ownership. A nationwide class action has been filed against automaker DaimlerChrysler AG and its U.S. subsidiary on behalf of owners of 1998 through 2003 model year Dodge Durangos, alleging that the vehicles have defectively-designed upper ball joints that wear prematurely and fail suddenly and violently.
 
The parties have reached a settlement apparently valued at $6.5 million in a 38-state action filed against Ford Motor Credit Corporation on behalf of Ford and Lincoln Mercury “Red Carpet” lease customers who allege that the company overcharged them for early lease termination fees between 1991 and 1995. Persons eligible to take part in the settlement should contact the settlement claims administrator for more information.
 
Vehicle leases, like other contracts, are governed by the actual language within the contract itself, and the parties may not add or subtract anything from that agreement. A Florida class action has been filed against auto leasing company U.B. Vehicle Leasing, Inc., on behalf of vehicle lessees who allege that the company charged them "taxes" that were actually just undisclosed fees to cover wear and tear, and excess mileage on the vehicles, in violation of Florida consumer protection laws and the federal Consumer Leasing Act.
