A Florida class action has been filed against auto financing company Chase Manhattan Automotive Finance Corporation on behalf of vehicle lessees who allege that the company charged them "taxes" that were actually just undisclosed fees to cover wear and tear, and excess mileage on the vehicles, in violation of Florida consumer protection laws and the federal Consumer Leasing Act. The action seeks unspecified compensatory damages.
Though the action is currently restricted to Floridians who have leases with Chase Manhattan Automotive Finance Corporation, or whose lease with the company expired in the last year, the attorneys who filed this action are interested in hearing from persons who lease or have leased vehicles in other states as well. Other Automotive Cases of Interest The parties have reached a settlement apparently valued at $6.5 million in a 38-state action filed against Ford Motor Credit Corporation on behalf of Ford and Lincoln Mercury “Red Carpet” lease customers who allege that the company overcharged them for early lease termination fees between 1991 and 1995. The parties have reached a tentative settlement apparently valued at $300,000 in a class action against car rental booking agency Auto Europe, LLC on behalf of all persons who rented cars for use in Europe either directly from the company or through a travel agent, during the period July 1, 1998, through June 30, 2001. To participate in the settlement, claimants must submit a proof of claim form on or before January 13, 2004. Tele-Aid is the concierge service provided in Mercedes-Benz vehicles, similar to Gm's OnStar- made famous by the company’s ad campaign featuring folks getting locked out of their cars or calling for help after an accident. Kanawha County Circuit Judge Paul Zakaib certified a class-action lawsuit against C&O Motors Inc., Love Daewoo Inc. and Saint Albans Import Inc.
The class involves anyone who bought a new Daewoo automobile from C&O Motors between Feb. 1, 2002, and Aug. 2, 2002. Trial is set for Jan. 23, 2006. Commission-based sales positions can be lucrative--if your boss actually pays your whole commission. A class action has been filed against Landers Auto Sales, Inc. and related companies on behalf of Landers salespersons in Arkansas, Tennessee, and Mississippi, alleging that the company bilked them of their commissions, unjustly enriching itself by taking keeping money that should have been paid as commissions.
Thousands of New Jersey motorists will be eligible for a payback under terms of a class action settlement.
The settlement would cover consumers who bought or leased a new or used vehicle from one of more than 397 various New England dealerships in the last eight years. |
