Floridians Take Allstate Indemnity Company to Court Over Refusal to Pay for MRI Exams

A Florida class action has been filed against Allstate Indemnity Company and affiliate Deerbrook Insurance Company on behalf of insurance policyholders who allege that the companies wrongfully denied coverage for magnetic resonance imaging (MRI) exams in violation of policyholders' personal injury protection (PIP) policies and Florida law. The action seeks payment or reimbursement of all MRI costs incurred by Florida-based imaging centers or Allstate's Florida policyholders during 2002 and 2003.

The action alleges that requests for reimbursement sent during the period to Allstate Indemnity or Deerbrook Insurance, which are both subsidiaries of Allstate Insurance, were routinely denied for the same stated reason: lack of medical necessity. The class plaintiffs are insureds of Allstate and Deerbrook who suffered automobile accidents and received MRI tests pursuant to orders of their treating physicians. The action alleges that these denials by Allstate and Deerbrook amount to second-guessing the medical need for MRIs, even though the MRIs were ordered by treating physicians and even though Allstate and Deerbrook are not licensed to practice medicine.

The claim is substantial, as MRI exams typically cost more than one thousand dollars each.

A class action has been filed against Aetna Health, Inc., a subsidiary of healthcare giant Aetna, Inc., on behalf of Pennsylvania residents (1) who, between September 26, 1999, and the date of the final judgment in the action, were injured in a motor vehicle accident while insured under an Aetna heathcare plan; and (2) whose tort recovery from the accident was subject to a lien asserted by Aetna. The action seeks compensatory and statutory damages for monies collected via the liens as well as injunctive and declaratory relief.
 
A class action has been filed against Pacific Life Insurance Company by persons in the United States who, through their ownership of a Pacific Life annuity or insurance product, held units of any Pacific Life sub-account invested in mutual funds which included foreign securities. The actions claim that the defendants violated federal securities laws by utilizing market timing strategies to increase company profits to the detriment of annuity holders.
 
The parties have reached a tentative nationwide $5 million settlement in an action filed against major cellular phone services and three insurance companies on behalf of all persons who purchased wireless equipment insurance between January 1, 1986, and February 20, 2004, through a wireless equipment insurance program administered by Asurion Insurance Services, Inc., Lockton Companies, Inc., or Lock\Line, LLC. The action alleged that the insurance programs failed to comply with applicable state insurance statutes and were marketed in a manner that failed to comply with Pennsylvania's consumer protection statutes. Proof of claim forms must be postmarked on or before August 9, 2004, to be considered valid.
 
"Reasonable and customary" provisions in healthcare policies often determine how much the insurer will pay on claims. The parties have reached a tentative $630,000 settlement in a class action against Educators Mutual Life Insurance Company on behalf of all persons who allege that. since September 1, 1998, the company reduced benefit payments for anesthesia services in violation of its contract with them.
 
What good is insurance if it doesn’t pay up when you need it? The parties have reached a $20 million settlement in an action filed against Midwestern insurance company Central States Health and Life Company of Omaha on behalf of cancer patients and their families who alleged that the company refused to pay for certain treatments allegedly covered under cancer insurance policies it sold, in violation of its contracts with the patients.
