Kahn Gauthier Swick is investigating possible legal actions on behalf of uninsured or partially insured patients who have been overcharged by Tenet Healthcare Corporation, the second-largest healthcare provider in the U.S. Patient advocates claim that Tenet takes advantage of uninsured patients by charging them rates that are twice the industry norm, several multiples over the rates charged insured patients, and much more than the cost of the service. The investigation is on behalf of a proposed national class of individuals residing in the United States who, between February 1999 and the present, received treatment at a Tenet hospital and were uninsured or partially insured at the time of treatment.
Patients who are admitted to a Tenet facility sign an Admission Agreement stating that patients will be charged the "reasonable" or "regular" rates of the hospital. However, the action alleges that uninsured and partially-insured patients are charged much more than fully-insured patients. For example, for the year 2001 in California, Tenet's gross charges for self-paying inpatients averaged $9,659 per day, while the gross charges for self-paying patients at non-Tenet acute care hospitals averaged $2,878 per day. The action specifically alleges that the defendants imposed grossly excessive charges on patients who did not have health insurance coverage or who were not insured by a health insurance carrier in contract with Tenet. The action further alleges that the defendants used coercive, unfair and fraudulent collection methods to collect the improper charges and issued negative reports to credit reporting agencies on patients who failed to pay the exorbitant charges.
