Bethlehem, Penn., Class Certified Against Portnoff Law Associates for Debt Collection Violations

The class has been certified in a class action against municipal debt collector Portnoff Law Associates, Ltd. on behalf of all persons who, between January 1, 2002, and March 31, 2003, received communications from Portnoff relating to municipal claims for water and sewer assessments asserted by the city of Bethlehem, Pennsylvania. The letters may also have sought fees and costs imposed under the Pennsylvania's Municipal and Tax Liens Act and local ordinances. The action alleges that the firm violated the federal Fair Debt Collections Act (FDCA) by sending non-conforming demand letters to debtors. The action seeks compensatory and punitive damages, and an order from the court that will force Portnoff to comply fully with the FDCA.

Bridget Piper alleges that she received a letter from Portnoff that indicated that she had a $252.75 delinquent water bill on which she owed $465 in assessments to the city. In violation of the FDCA, the letter allegedly failed to indicate that it was from a debt collector, failed to tell her that she had a right to dispute the debt, and charged fees that weren't authorized by law to the extent that her bill grew to more than $2,805.

Excluded from the class are all businesses and persons who own their property for business purposes.

The action is currently scheduled for a jury trial on September 9, 2003.

The parties have reached a tentative settlement in an Indiana class action against short-term loan provider E-Z Cash Systems, Inc. on behalf of all persons who took out a loan with the business and were forced to pay an interest rate that was allegedly too high in violation of state and federal lending laws.
 
A nationwide class action has been filed against collection agency Gold Key Credit, Inc., on behalf of all US residents who have been wrongly billed overdue charges by the company, its parents, or its subsidiaries. The action alleges that Gold Key has violated the federal Fair Debt Collection Act and the Florida Consumer Collection Practices Act.
 
A class action has been filed against Fountainhead Title Group Corporation and numerous affiliated businesses and mortgage companies on behalf of all Maryland borrowers who entered into mortgage loan transactions using the services of Fountainhead Title where the HUD-1 Settlement Statement, or other document in the loan file, includes a charge for or payment to an Affiliated Business Arrangement for title or closing services. The action alleges that the affiliated businesses are actually shams that allow the title company and mortgage companies to charge borrowers false fees, in violation of the federal Real Estate Settlement Procedures Act and the Maryland Consumer Protection Act.
 
The Federal Trade Commission announced that it had reached a $15 million settlement with ChoicePoint Inc., the commercial data broker that disclosed last February that thieves had duped the company into turning over private data on more than 145,000 people.
 
A class action lawsuit has been filed in the Western District Court of Michigan against the law firm of Muller, Muller, Richmond, Harms, Myers & Sgroi, PC for violations of the Fair Debt Collection Act. The class seeks a declaratory judgment, an injunction, damages, attorney's fees and costs of the action.
