AOL Agrees to Pay $525,000 to Users Who Didn't Get Rewards Points for Signing Up With Talk America |

The parties have reached a nationwide $525,000 settlement in a class action against America Online, Inc. and Talk America, Inc. on behalf of all persons who signed up for long-distance telephone service with Talk America pursuant to a "free AOL" offer, at any time between December 3, 1997, and October 1, 2001. The action alleged that AOL breached the parties' contracts and violated certain provisions of California law when it failed to provide AOL Rewards points that could be used for one or more free months of America Online service to customers who contracted for AOL Long Distance telephone service provided by Talk America. Class members must submit claim forms by August 1, 2003, in order to be eligible to take part in the settlement.
The class is specifically composed of current and former AOL customers who signed up for the Talk America program and made at least one payment under that program but who did not receive any of the AOL Rewards points to which they were entitled under the program. The settlement provides for each eligible class member to receive a credit equivalent to one free month of AOL's standard, narrowband service. The credit does not include telephone charges, premium surcharges or similar charges. Class members who are not current AOL users will receive a similar credit, but will have to subscribe to AOL to use it. The credit will be considered in addition to any marketing promotion that AOL is currently offering.

The Electronic Frontier Foundation filed a lawsuit against Sony BMG, demanding that the company repair the damage done by the First4Internet XCP and SunnComm MediaMax software it included on over 24 million music CDs. The parties have reached a tentative $3 million settlement in several consolidated actions filed against manufacturer and distributor of digital subscriber line (DSL) products Paradyne Networks, Inc. (Nasdaq:PDYN) and certain of its officers and directors by stockholders who purchased the company's common stock between March 20, 2000, and September 28, 2000. The actions allege that the defendants misled stockholders about its future earnings in violation of federal securities laws. Persons eligible to participate in the settlement must file a proof of claim postmarked no later than July 12, 2004. The parties have reached a tentative $110 million settlement in several class actions filed against communications networking and services company Avaya, Inc., on behalf of persons and businesses whose Avaya telecommunications products did not process date functions correctly when their internal clocks switched to January 1, 2000, because of Y2K incompatibilities. Micron Technology faces another class action lawsuit tied to alleged involvement in an supposed price-fixing scheme among memory chip makers between February 2001 and February 2003. The class action, which is the third of its kind involving price fixing, was filed on behalf of Micron shareholders in U.S. District Court in Idaho against Micron and certain of its officers and directors. The complaint alleges that Micron was engaged in a scheme to manipulate the price of DRAM between Feb. 24, 2001 and Feb. 13, 2003. A class action has been filed against Concord Camera Corporation, a worldwide designer, developer, manufacturer and seller of image capture products (NASDAQ: LENS) and certain of its officers and directors by stockholders who purchased the company’s common stock between August 14, 2003 and May, 10, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company’s securities. The stockholders seek to recover compensatory damages for the loss of value of their stock. Telephone technology has made great leaps forward over the last 40 years. A $138 million class action has been filed against telephone service provider Verizon Hawaii, Inc. on behalf of all Hawaiians who have allegedly paid an extra fee for touch-tone service over a 14-year period, in violation of the state's consumer protection laws.
