Blue Cross of CA Policyholders Allege Company Made Unfair Changes to Policies |

A class action has been filed against Blue Cross of California on behalf of policyholders who allege that the insurer wrongfully changed their healthcare policies' premium basis from their age at initial enrollment to their attained ages at renewal time, in violation of the terms of the policies. The action seeks unspecified compensatory damages.
Deborah Kavruck allegedly bought a Blue Cross individual health insurance policy with premiums that were rated based on her initial enrollment age in 1984. Three years later, the action alleges that Blue Cross stopped marketing the entry age policies, even though existing policies remained in effect. Then, in 1994, the health care plan allegedly transferred her and other subscribers' entry-age policies into new policies in which the premiums were calculated based on the subscriber's actual age at the time of renewal. This allegedly caused a rise in Ms. Kavruck's premiums.
The action has been certified on the claims of breach of contract and breach of the implied covenant of good faith. The class is made up of subscribers whose health insurance policies were changed so that their premiums were no longer based on their initial enrollment age but on their attained age at the time of renewal.

Several class actions have been filed against pharmaceuticals and healthcare supply wholesaler D&K Healthcare Resources, Inc. (Nasdaq:DKHR) and certain of its officers and directors by stockholders who purchased the company's common stock between April 23, 2001, and September 16, 2002. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. Numerous drug companies have recently been charged with requesting fraudulent patents. A class action has been filed against Purdue Pharma, LP, the manufacturer of the popular painkiller, OxyContin, on the behalf of purchasers who allege that the company fraudulently secured patents on the drug in an effort to stave off cheaper generic competition. A $100 million class action has been filed against pharmacy operator Eckerd Corporation on behalf of persons who allege that, even though they paid full price for their prescriptions, they did not receive the full amount of drugs they were prescribed. The action cites violations of Florida's consumer protection laws, and seeks compensatory damages to compensate Eckerd customers. Children are especially susceptible to lead poisoning, which can result in permanent brain damage. A class action has been filed against the Washington, D.C. Water and Sewer Authority (WASA) on behalf of District residents who allege that the Authority has known that their drinking water was contaminated with lead since the summer of 2001, but didn't take any remedial action or notify the public, in violation of federal environmental law.
