SC Patients Take Piedmont Medical Center Hospital to Court for Being the Most Expensive Hospital in the Area

A class action has been filed against Piedmont Medical Center Hospital in Rock Hill, South Carolina, on behalf of all patients who were treated from January 1, 1997 to the eventual date of any judgment in the action, alleging that the Tenet Healthcare-owned facility overcharged them in violation of its own price gap contract provisions that are designed to keep it from being the most expensive hospital in the vicinity. The action seeks disgorgement of all profits that the hospital made from alleged overcharges.

Wade Comer alleges that Piedmont overcharged him $90,000 for medicine and services for his heart condition for at least four years, in violation of its contract with the local county. Among other things, he alleges that he was charged $40 for two milliliters of sterile water and $19 per blood sugar test, with as many as 20 tests in a day.

The hospital was originally operated by York County as its general hospital until 1979. In 1980, it was sold to American Medical International, which was eventually purchased by Tenet, a 114-hospital chain based in Santa Barbara, California. In 1996, the contract between Tenet and the county allegedly included a price cap amendment that the hospital could not be the most expensive "among its peers." Ten local hospitals around the state were allegedly used as a benchmark. The action alleges that the amendment also required Piedmont to fix its prices if they are the highest.

Piedmont allegedly charges an average 95 percent to 116 percent more than its nearest rival. Across the board, or the all-cases average, the hospital allegedly charged 33 percent more than the other hospitals. The action alleges that Piedmont's prices increased 113 percent between 1995 and 2001, while charges at a peer hospital in Charlotte, North Carolina, rose only 40 percent.
