Kahn Gauthier Swick is investigating possible legal actions against healthcare products manufacturers Baxter International and Medisystems Corporation following the report of five deaths in kidney dialysis patients that may have been due to a particular combination of dialysis machine and blood tubing. The deaths occurred in patients who were given dialysis from Baxter's Meridian dialysis machines using Medisystems blood tubing with product code D3-9694/9793 or K3-9694/9793, which corresponds to Baxter product code 5M9694.
The deaths occurred in late August at dialysis centers in Mishawaka, Indiana, and Grand Rapids, Michigan. According to the U.S. Food and Drug Administration, details of the incidents are "sketchy," but a Baxter representative has said that the tubing may have kinked. Alternative Medisystems blood tubing is available for the Meridian dialysis machines. Baxter told customers to immediately discontinue the use of that combination of dialysis machine and tubing. Baxter's warning was sent to 16 dialysis centers that may have been using the combination. GlaxoSmithKline and the FDA notified physicians of changes to the pregnancy/precautions section of the prescribing information for Paxil and Paxil CR Controlled-Release Tablets. Glaxo's studies suggest Paxil may be more likely to be linked to birth defects than similar drugs. A class action has been filed against pharmaceutical company SmithKline Beecham Corporation on behalf of all persons who purchased the antidepressant Paxil or Paxil CR (paroxatine) for children under the age of 18 between November 19, 1998, and the present. The suit alleges that the company committed fraud by suppressing clinical study data that indicated Paxil was ineffective for children. A class action has been filed against pharmaceutical manufacturer Pfizer, Inc., Parke-Davis, and Warner-Lambert Company on behalf of persons who paid out-of-pocket expenses for the drug Neurontin (gabapentin), who allege that the companies harmed consumers, by conspiring to circumvent drug approval regulations set up by the U.S. Food and Drug Administration (FDA), and promoting scientifically unproven "off-label" use of the drug, in violation of the federal Racketeer Influenced and Corrupt Organizations Act. A federal class action has been filed against the Kentucky based Trover Clinic Foundation and its associated network of hospitals and medical officers. The suit alleges that over 415 individuals who sued Trover Clinic in state court were subsequently contacted and told that they would not be treated at any Trover affiliated facility unless they accepted the terms of a settlement offer put forward by Trover. Many of the plaintiffs are cancer patients who would have been forced to seek treatment out of state as a result of Trover's refusal to treat them. |
